Terms and Conditions — Urban Property Management

Urban Property Management ("Urban," "we," "us," "our"), registered at 6 KG 598 Street, Kigali, is part of the Fortico Group, sister company to Delta Developers. These Terms and Conditions ("Terms") govern your use of urban-rwanda.com (the "Website") and apply to all visitors, prospective tenants, and property owners or developers inquiring about our property management services, regardless of where you are located.

This is an international website. We welcome inquiries from Rwandan residents and citizens as well as international and diaspora tenants and property owners, subject to applicable Rwandan law as described in Section 10.

By using the Website, you accept these Terms. If you do not agree with any part of them, please do not use the Website.

Information on the Website — including unit availability, rental rates, photographs, and descriptions — is provided for general marketing purposes only. It does not constitute a legal offer, a binding tenancy, or a guarantee that any specific unit is available.

A binding tenancy only arises once we have received and confirmed your security deposit and a formal Lease Agreement has been signed by both parties. Until then, any unit shown as available may be leased to another tenant without notice to you.

Similarly, property management services for owners and developers only begin once a formal Property Management Agreement has been signed by both parties. Information on the Website about our management services is provided for general marketing purposes only and does not constitute a binding offer.

Rental prices are quoted in United States Dollars (USD) unless stated otherwise.

Security deposits and monthly rent are payable as stated in your Lease Agreement, in the currency and by the payment method specified there. Rwandan citizens may choose to pay in Rwandan Francs (RWF) instead of USD, converted at the prevailing National Bank of Rwanda exchange rate on the payment date, unless we agree otherwise with you in writing.

Prices shown on the Website may be updated at any time before a unit is booked. Once a security deposit for a specific unit is confirmed, the rental rate for that unit is held as set out in the applicable Lease Agreement.

Urban Property Management acts as manager and, where applicable, letting agent for the properties listed on the Website. We do not sell property, and nothing on the Website constitutes advice on property ownership, title, or Rwandan land law.

Owners and developers engaging our property management services remain the legal owners of their properties at all times; our role is limited to the services described in the applicable Property Management Agreement.

We recommend that tenants and owners obtain independent legal advice on any matter relating to Rwandan property or tenancy law before signing a Lease Agreement or Property Management Agreement.

All photographs, images, floorplans, and descriptions of finishes, fixtures, furniture, amenities, or views shown on the Website or in any marketing material are indicative examples only. They are intended to give a general impression of a unit or residence and are not part of any contractual specification.

The actual condition of a unit at move-in may differ from these materials, including in furnishing, fixtures, decor, or minor wear, due to ongoing maintenance, tenant turnover, or supplier availability.

All dimensions and areas (including sqm figures) are approximate.

Where any marketing material conflicts with your signed Lease Agreement, the Lease Agreement takes precedence.

The process, amounts, and deadlines for booking a unit, paying a security deposit, and paying rent are set out in the Lease Agreement issued to you for your specific unit, and form part of these Terms by reference.

Security deposits are refundable subject to the conditions stated in your Lease Agreement (e.g. no damage beyond normal wear and tear, rent paid in full).

You may pay using the methods we make available to you, which may include bank transfer, mobile money, or a designated online payment provider. You are responsible for any fees charged by your own bank or payment provider.

As is standard for rental transactions, we may need to verify your identity before confirming a booking, in line with applicable Rwandan law.

Owners and developers who engage Urban Property Management to manage their property do so under a separate, individually signed Property Management Agreement, which governs matters such as fees, tenant sourcing, maintenance, and reporting. These Website Terms do not themselves constitute a Property Management Agreement and do not override its terms.

Information on the Website about our management services, including any descriptions of our process or fees, is indicative and subject to confirmation in your individual Property Management Agreement.

All content on the Website — including text, images, the "Urban Property Management" name and logo, and the Website's design — is owned by or licensed to us. You may not copy, reproduce, or otherwise use this content beyond personal, non-commercial use in evaluating a potential tenancy or management arrangement, without our prior written consent.

The Website and its content are provided "as is." While we aim to keep information accurate and current, we do not guarantee the Website is free of errors, and we are not liable for losses arising from reliance on its content, except where such liability cannot be limited under Rwandan law.

Nothing in these Terms limits our liability for fraud, or for death or personal injury caused by our negligence, where such a limitation is not permitted by law.

These Terms, and any tenancy or property management arrangement with Urban Property Management, are governed by the laws of the Republic of Rwanda.

Any dispute arising from these Terms, a tenancy, or a property management arrangement is subject to the exclusive jurisdiction of the competent courts of Rwanda, unless your signed Lease Agreement or Property Management Agreement states otherwise.

We may update these Terms from time to time. The version published on the Website at the time you book a unit or sign a Property Management Agreement will apply to you, and any later changes will not be applied retroactively without your consent.
